Price, specification, and terms are subject to change without notice. Purchasing via Amazon, Shopify, PayPal or other payment methods are subject to each entity’s governing terms and conditions.

Cerveza Mixers currently accepts the following payment methods:

Credit Card

Forms of credit card payments accepted: American Express: Diners Club, Discover, JCB, Master Card, Visa, etc.

Orders will be processed and shipped after the receipt and clearance of a payment.

CREDIT CARD AUTHORIZATION

Credit card issuers may place a temporary "authorization hold" on your account to verify that funds are available for a given purchase. In the event that the security code or billing address supplied by you does not match the records of your card issuer, the transaction will be voided and Cerveza Mixers will not accept your payment. However, the card issuer may take up to 7 days to release the funds back into your account. Please contact your credit card issuer for more information on their authorization policies.

GENERAL TERMS AND CONDITIONS

Cerveza Mixers Purchase Agreement

By placing an order from Cerveza Mixers Inc. (“Cerveza Mixers.”), you (“Customer”) agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Cerveza Mixers. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice.

Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Cerveza Mixers Inc.

Payment Terms on Orders

An order is not binding upon Cerveza Mixers until it is accepted. Cerveza Mixers must receive payment before it will accept an order or process any shipment.

Shipping Charges/State Taxes

Shipping charges are determined by either weight and class of shipping method or standard flat fee, excluding applicable sales tax. Your completed invoice will designate any shipping and handling charges as well as applicable state sales tax.

Processing Time

Your order will typically be processed within 1 business day, unless otherwise alerted based on inventory availability. Cerveza Mixers aims to ship your order within 1-2 days of order placement unless otherwise communicated.

If you need an item by a certain date, please check the fastest shipping method regarding availability of the item and shipping options.

Back Orders

Any items that are unavailable will be placed on back order. Estimated ship dates will be provided, however please note that these dates are "estimates" and there is no guarantee that the items will arrive by that date.

Order Status

Cerveza Mixers will do everything possible to keep you informed of your order via e-mail. Your tracking number will be emailed to you once the item is shipped.

Shipping Policy

Cerveza Mixers will carefully prepare and inspect all shipments. An independent shipping contractor such as USPS, FedEx, UPS, or a commercial trucking company will deliver the order. When the shipment arrives, please inspect the package(s) closely. Note any box damage including scuffs, dents, tears, punctures or creases. If there is anything unusual with the package, you have the right to open the package to inspect the contents.

Return and Replacement Policy

Since our products are perishable after opening, we do not have a return policy. However, IF THERE IS DAMAGE TO THE SHIPMENT (BREAKAGE OF BOTTLE), THEN YOU MUST CONTACT CERVEZA MIXER IMMEDIATELY AT THE FOLLOWING EMAIL ADDRESS: INFO@CERVEZAMIXERS.COM for possible replacement. Photographs of the broken bottle(s) may be required as part of the return process.

Cancellation Policy

To cancel your order, please email directly to INFO@CERVEZAMIXERS.COM during our normal business to our customer service department. Provided your order has not yet been processed, and your credit card has not been charged, there is no fee. If your order has already been processed and your card was charged, a 5% cancellation fee will be deducted from your refund. If any portion of your order has shipped, a 15% restocking fee will be deducted from your refund. The refund will occur within 48 hours of the receipt of the cancellation or the return of all products that have shipped.

Product Listings

Cerveza Mixers strives to be as accurate as possible in our product descriptions, compatibility references, information, content, pricing, links and any other product information contained in or referenced on our site. In the event that a product is listed at an incorrect price due to typographical or any other error, Cerveza Mixers, at its sole discretion, will have the right to refuse or cancel any order for that product and immediately amend, correct or remove the inaccurate information. Moreover, all links on the Cerveza Mixers website are intended only to provide visitors with assistance finding additional information and a place for sales transactions. Please remember to consider that you, our valued customer, are ultimately responsible for any and all purchase decisions.

Security

Security is our number one priority. All online transactions are sent through secure servers and encrypted. Once the information is received through the internet, trusted authorized employees will process your payment, and make sure that your information is handled with the highest level of security. Credit card information is not stored on our computers once an order is completed, so you will be asked to provide your credit card information with each new order.

Title & Risk of Loss

Cerveza Mixers will arrange for shipment of ordered product(s) to you, Free On Board (F.O.B.) shipping point, meaning title to the product(s) and risk of loss passes to you upon delivery to the carrier. Cerveza Mixers reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Cerveza Mixers will advise you of estimated shipping dates, but Cerveza Mixers will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

Governing Law and Jurisdiction

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Cerveza Mixers and you will be governed by the laws of the State of California, without regard to its conflicts of law rules. You and Cerveza Mixers consent to the exclusive jurisdiction and the venue of the State Courts of the State of California, city of San Francisco, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, you also agree not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Cerveza Mixers that is more than one year after the date of the applicable invoice.

Severability

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability will not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision will be deemed modified so as to have the most similar result that is valid and enforceable under applicable California law.

Waiver

The failure of either party to require performance by the other party of any provision of this agreement will not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement will not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement

These terms and conditions, together with Cerveza Mixers’ invoice for the products ordered by you, are the complete and exclusive agreement between Cerveza Mixers and you, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between Cerveza Mixers and you relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
